Subbii - Terms of Service
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User" or "you") and Subbii ("Subbii," "we," "our," or "us"). By accessing or using the Subbii platform, including its website and mobile applications (collectively, the "Platform"), you agree to be bound by these Terms.
1. Platform Overview
1.1 Introduction:
Subbii provides a platform that connects users looking to sublet their properties with individuals seeking medium-term accommodations ("Users").
1.2 Scope:
These Terms govern your use of the Subbii Platform. Users may include individuals subletting their properties ("Sublessors") and those seeking to rent these properties ("Sublessees").
1.3 Searching
You can search for listings by using search criteria like rental dates and budget. You can also use filters to refine your search. Search results are based on their relevance to your search and criteria. The results consider factors such as price and availability.
2. User Responsibilities
2.1 Eligibility:
Users must be at least 18 years old and have the legal capacity to enter into binding agreements.
2.2 Accurate Information:
Users are responsible for providing accurate and up-to-date information during account creation and when using the Platform.
2.3 Sublessor Terms:
Sublessors are responsible for ensuring that they give their lessor notice, in writing, with the name and address of the person who is interested in subletting their place. As stated by the Tribunal Administratif du Logement, this information is mandatory in order to sublet your place. When you accept a booking request or receive a booking confirmation through Subbii’s platform, you are entering into a contract directly with the sublessee and are responsible for delivering all that is indicated in your listing details.
You are responsible for understanding and complying with any laws, rules, regulations with third parties that apply to your listing (condominium association rules or landlord rules). You acknowledge that subletting carries inherent risks and agree that you assume the entire risk arising out of your access to and use of the Subbii Platform, offering subletting services, or any interaction you have with other users whether in person or online. You agree that you have had the opportunity to investigate the Subbii Platform and any laws, rules, regulations, or obligations that may be applicable to your listings or subletting services and that you are not relying upon any statement of law made by Subbii.
2.3 Sublessor Terms:
The sublessee agrees to pay the monthly rent to the sublessor for the duration indicated on the sublet agreement.
The sublessee agrees to maintain the property in good condition and promptly report any damages or needed repairs to the sublessor.
The sublessee agrees to use the property solely for residential purposes and not to engage in any unlawful activities on the premises.
The sublet term begins and ends on the start and end dates indicated on the sublet agreement. The sublessee agrees to vacate the premises by the end of the term.
3. Booking, Cancellations and Financial Transactions
3.1 Booking Process:
Subbii facilitates the booking process, including payment transactions, between Sublessors and Sublessees. When you book a place, you are agreeing to pay all charges for your booking, including the listing price and applicable fees, like Subbii’s service fee. You are also agreeing that Subbii may charge the payment method used to book the listing to collect payments for any damages caused by you during your stay. When you receive the booking confirmation, a contract for the subletting agreement is formed directly between you and the sublandlord. In addition to these terms, you will be subject to, and responsible for, complying with, all terms of the booking, without limitation, the cancellation policy and any other rules, policies or requirements identified in the listing that apply to the booking. It is your responsibility to read and understand these rules, policies and requirements prior to making a booking
3.2 Cancellation of booking
In the event of the need for cancellation or termination of the sublet lease agreement, the Parties agree to adhere to the rules and procedures outlined by the Tribunal administratif du logement (TAL) of Quebec. Any party seeking to cancel or terminate this agreement shall follow the legal processes and regulations set forth by the TAL, including but not limited to providing the required notice periods as stipulated by the TAL. The Parties acknowledge that the rules and regulations governing lease agreements, subletting, and cancellations fall under the jurisdiction of the Tribunal administratif du logement of Quebec, and any cancellation must be conducted in compliance with the applicable laws and procedures. During the term of a sublease agreement, the sublessee and sublessor cannot terminate the agreement for any reason except for specific situations stated by the TAL
If a sublessee cancels a booking after both parties have signed the sublet lease agreement without a valid reason (set by TAL), they will be charged the monthly amount owed to the sublessor for the duration indicated on the lease agreement.
All parties agree that any disputes or claims arising out of or in connection with the use of the Subbii shall be subject to the exclusive jurisdiction of the city in which the sublet is located. By using the Subbii platform, you acknowledge and agree that Subbii, its affiliates, directors, employees and representatives shall not be liable for any fees, claims, disputes or damages arising out of or in connection with the use of the Subbii platform.
3.3 Fees:
Subbii charges sublessees a 3% fee for its services, which will be included in the listing price.
4. User Conduct
4.1 Prohibited Activities:
Users must not engage in activities that violate these Terms, including but not limited to fraudulent or illegal activities.
4.2 Community Standards:
Users are expected to adhere to community standards that promote a positive and respectful environment on the Platform.
5. Intellectual Property
5.1 Platform Content:
Subbii retains ownership of its platform, including content, trademarks, and intellectual property.
5.2 User Content:
By posting content on Subbii, users grant Subbii a license to use, display, and distribute that content for platform operations
6. Disclaimers and Limitation of Liability
6.1 Platform "As Is":
Subbii provides the Platform "as-is" and does not guarantee its accuracy, completeness, or reliability.
6.2 Limitation of Liability:
To the extent permitted by law, Subbii shall not be liable for any indirect, incidental, or consequential damages
7. Termination
7.1 Termination by User:
Users may terminate their accounts at any time.
7.2 Termination by Subbii:
Subbii may suspend or terminate accounts for violations of these Terms or for other reasons at its discretion.
8. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of laws principles. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of [Jurisdiction].
9. General
9.1 Severability:
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
9.2 Entire Agreement:
These Terms constitute the entire agreement between you and Subbii regarding the use of the Platform.
9.3 Reviews:
After each subletting experience, Sublessors and sublessees will have the opportunity to review each other. Reviews must be accurate and may not contain any discriminatory, offensive, defamatory content. Reviews are not verified by Subbii for accuracy and may be incorrect or misleading. Reviews that violate this policy will be removed and may result in the termination of your account.
10. Privacy
By using the Subbii Platform, you acknowledge that you have read, understood, and agreed to our Privacy Policy.
